As a member of ThePerfumeClub (www.theperfumeclub.com) (“member”, “you” or “your”), you may have an opportunity to participate in prize drawings (“Drawings”) organized from time to time by Givaudan Fragrances Corporation (“Givaudan”, “we,” “our”, or “us”) in collaboration with our technical provider, Platform One.

Participation is open to all members who are residents of the United States and who meet the participation quota established by Givaudan from time to time (“Participation Quota”). Employees of Givaudan and its affiliates (collectively, the “Givaudan Group”) and their relatives are excluded from participating in the Drawings

As a member of ThePerfumeClub, you may be invited to participate in consumer product and fragrance related studies or surveys (“Surveys”). Each month there will be a prize drawing. All members that complete a survey within that month will be eligible for the Drawing. The number of points that members can earn for each survey is subject to variation, depending on the length and topic of the respective survey. Each earned point qualifies a member for one entry in the Drawing (e.g. if a member earned 10 points during the calendar month, this member will have ten entries in the Drawing). If you elect to participate in a Survey, you will automatically be entered into the applicable Drawing upon submitting a fully completed Survey within the time permitted (“Drawing Participant”). Only fully completed Survey questionnaires will entitle a member to be entered into a Drawing.

Winners of Drawings will be selected as follows: a random number will be assigned to each Drawing Participant in the applicable Drawing. The numbers will then be arranged in descending order (highest number to lowest number). The winners will be the ten Drawing Participants at the top of this list or, in other words, the Drawing Participants who have been assigned the two highest numbers. The Drawings will be held without a notary or auditor in attendance. The winners for each month will generally be drawn within 10 days after the end of that month.

Givaudan reserves the right to verify compliance with the Drawing Rules and Conditions and, in the event of manipulation attempts, to exclude any members or Drawing Participants involved from participating in a Drawing and expel them from ThePerfumeClub. All such decisions are final and at Givaudan’s sole discretion.

There will be ten (10) winners for each Drawing. Each winner will receive a fifteen U.S. dollar ($15.00) Sephora gift card. The terms governing the use of Sephora gift cards can be found on the Sephora website at www.sephora.com. We reserve the right to replace one or more of the prizes with a prize of equivalent value. In no case will prizes be paid out in cash. Givaudan does not accept any responsibly for (i) the quality or condition of any prize awarded; or (ii) any issue or problem a winner may have in redeeming any such prizes.

Following each Drawing, winners will be notified by e-mail using the e-mail address provided on the registration form completed by each Member upon joining ThePerfumeClub. This email will contain a Sephora gift card code to be used on the Sephora website. In the event that the notification is undeliverable for reasons beyond our control (e.g., incorrect email address provided), any entitlement to the prize shall lapse without recourse.

Givaudan reserves the right to terminate, extend or cancel any Drawing at any time by means of a simple online notification published on www.theperfumeclub.com, without liability to Givaudan. In addition, these Drawing Rules and Conditions may be modified, amended, changed or augmented, from time to time by us, and any such modification, amendment, change or addition will take effect immediately upon posting on www.theperfumeclub.com.

Membership in ThePerfumeClub and participation in Drawings for eligible Drawing Participants are free of charge and do not obligate any member or Drawing Participant to make a purchase of any kind; however, a computer, tablet or telephone with a connection to the internet and an email account (all at Drawing Participant’s sole cost and expense) are required to participate.

The information and data collected to verify participation in a Drawing is subject to our separate Privacy Policy, which can be found on our website, www.theperfumeclub.com.

Participation in a Drawing will be construed as a Drawing Participant’s pledge to adhere to these Drawing Rules and Conditions, the Privacy Policy and the Terms of Use for ThePerfumeClub. If you, as a member or Drawing Participant, do not agree to any of the foregoing, you are not permitted to be a member in ThePerfumeClub or participate in any Drawing and you must immediately cease use of our website.

Each company in the Givaudan Group and their business partners, including, but not limited to, Platform One, assume no liability relating to your membership in ThePerfumeClub or participation in a Drawing. You participate in ThePerfumeClub and Drawings at your own risk, cost and expense. Givaudan may cancel, without liability, a Drawing for any reason at any time, including, but not limited to, circumstances outside of our control. You agree to hold harmless each company of the Givaudan Group and its business partners, from and against any and all claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses, relating to your participation in ThePerfumeClub or any Drawing.

The Drawings and these Drawing Rules and Conditions are subject to the laws of the State of New York, U.S.A.
